  1. damn, i can't watch this video...
"Unfortunately, this video is not available in Germany because it may contain music for which GEMA has not granted the respective music rights."

    •  is it possible to download that video from an other location... or can somebody put that video to an other video platform that has the permission from GEMA (e.g, vimeo)

        Better yet use open music.

        http://www.openmusicarchive.org/
        http://creativecommons.org/legalmusicforvideos

When you use that commercial stuff your video gets ads that make money to whomever is the copyright holder of that piece you used, by using CC-by-SA you don't have those problems, of course you have to still mind the mechanic sync rights and others, if memory serves there are 3 of 4 royalties payments you have to do in the standard copyright, by using CC you only have to do one and it is cheaper.

        http://pro.jamendo.com/stock-music-licensing

The advantage of using Jamendo is that you get a document saying you did pay for the rights and if any collection agency comes at your door you can sue them back and make them liable for it.

The other sources although free don't offer that so you need to have the link to their license or pages at all times to show others that you are using free legal music.

        • AnonymousCoward on

BTW Vimeo have a strict policy of not allowing commercial material in there, the fact that the music is commercial would make it a prime target for removal, although it doesn't happen that often it is what it states in the user agreement of the website and if they get a complaint from anywhere they just remove the video, also Vimeo is not authorized by Gema, Gema sued Google to get a ruling and now they probably go after all the other video platforms out there.

          •  hmm... that is complicated... and i thought only youtube is in conflict with GEMA... i never saw such a message on vimeo...
yeah, best choice is to use royalty free content only.

          • AnonymousCoward on

You probably never saw a message because Vimeo doesn't post any, they don't advertise some video was removed, the video is just gone, no explanations as to why it is gone.

Vimeo just deleted all of my videos without warning or specific explanation. Once I wrote back to them asking for explanations they have provided none. I have an account there since 4 years with lots of good videos, just like I do on all major video sharing sites. It is really a shame that Vimeo did this. I invite you to share this news with others.

            Repeat Infringer Policy

VIMEO will terminate user accounts that have been the subject of three (3) separate DMCA notices.
In the event a user’s materials are removed due to a DMCA notice and
then subsequently restored due to the filing of a DMCA
counter-notification, VIMEO will treat the underlying DMCA notice as
            withdrawn.

VIMEO reserves the right to terminate user accounts that
are the subject of fewer than three (3) DMCA notices in appropriate
circumstances, such as where the user has a history of violating or
willfully disregarding Vimeo’s Terms of Service.

One thing I forgot, if you use Vimeo to promote something of yours you better fight every DMCA's that goes your way or face the deletion of your account and subsequent loss of that address. Which is not a problem to most people.

But seriously, the music industry is bizarre, Warner Music claims copyrights on the "Happy Birthday" song and charges $10 grand or more if it appears anywhere in a movie.

        • AnonymousCoward on

Let me see if I remember all the rights that must be paid to use a music in a video in standard copyright.

Sync rights - the royalty you pay for the privilege of using an audio recording in a video.
          http://en.wikipedia.org/wiki/Synchronization_rights
Mechanical rights - the same as sync rights but generally charged appart
          http://en.wikipedia.org/wiki/Royalties#Mechanical_royalties

Performance rights - the right to display or perform the audio somewhere, you must get a license for that too.

Of course this is only in the US in other places it can be completely different and it is in many cases, there are moral rights to be aware of, that are the rights that some copyright owner or artists holds and gives a veto power or censor power over how the work is displayed, reproduced or performed.
